General Terms and Conditions of Participation for Competitions and Prize Draws on Social Media

of Ecomsky GmbH (elusa)

These terms and conditions apply to all competitions and prize draws organized by Ecomsky GmbH via its social media channels (e.g. prize draws in the comments, story competitions), unless different or additional terms are stated in the respective competition post.

§ 1 Organizer

(1) The organizer of the competitions is Ecomsky GmbH, Rote Straße 19, 37073 Göttingen (“Organizer"). The competitions are carried out via the organizer's official social media channels, in particular Instagram (@eilusade.com_) and TikTok (@eilusade.com).

(2) The competitions are in no way connected to Meta Platforms Inc. (Instagram, Facebook), TikTok, or other platform operators and are in no way sponsored, supported, or organized by them. The recipient of the information provided by participants is not the respective platform, but exclusively Ecomsky GmbH. Any questions, comments, or complaints regarding the competitions must be addressed exclusively to the organizer (Support@eilusade.com).

§ 2 Eligibility to Participate

(1) Eligible to participate are natural persons aged 18 or over who reside in Germany, Austria, or Switzerland and have their own account on the respective platform.

(2) Employees of Ecomsky GmbH, companies affiliated with it, and their family members are excluded from participation.

(3) Each person may participate only once per competition. Participation by the same person via multiple accounts is not permitted and entitles the organizer to exclude them.

(4) The organizer is entitled to exclude participants who violate these terms and conditions, provide false information, infringe third-party rights, or attempt to manipulate the competition (e.g. through fake accounts, bots, or automated processes). In such cases, prizes may also be revoked retroactively and reclaimed.

§ 3 Participation, Period, and Prizes

(1) The specific participation requirements (e.g. commenting, following the account, liking or sharing a post), the participation period, and the prizes on offer are set out in the respective competition post or story on the organizer's social media channel.

(2) Participation is free of charge. Purchasing products from the organizer is not a condition of participation and does not increase the chance of winning.

(3) If no participation period is stated in the post, the opportunity to participate ends when the draw takes place. The organizer reserves the right to extend the participation period by announcing it on the respective channel.

(4) By participating in the competition, participants accept these terms and conditions.

§ 4 Winner Selection and Notification

(1) After the participation period has ended, the winners will be selected at random from all eligible entries.

(2) Notification will be sent by direct message exclusively via the organizer's official accounts (Instagram: @eilusade.com_, TikTok: @eilusade.com) or – if known – by email, usually within 7 days after the draw.

(3) Important note: The organizer will never contact participants through other accounts and will never request payment details, credit card details, or payment of “shipping fees". Messages from similarly named accounts are attempts at fraud by third parties, for which the organizer is not responsible.

(4) Winners must respond within 7 days of receiving the notification and provide the data required to process the prize (first and last name, if applicable email address and postal address). If no response is received within this period, the claim to the prize expires and the organizer is entitled to draw a replacement winner.

(5) Winners are themselves responsible for the accuracy of the information provided. Any disadvantages resulting from incorrect information (e.g. non-deliverability) shall be borne by the winners.

§ 5 Prize Processing

(1) Physical prizes will be shipped to the specified residential address within the participation area (§ 2 para. 1). Vouchers or voucher codes may also be sent by email or direct message.

(2) Cash payment, exchange, or transfer of the prize to third parties is excluded, insofar as such a restriction is permitted under the mandatory applicable law.

(3) Winners are themselves responsible for any taxation of the prize.

§ 6 Early Termination and Changes

The organizer reserves the right to terminate, suspend, or adjust a competition at any time for good cause if proper execution cannot be guaranteed for technical or legal reasons. Any claims already accrued by selected winners shall remain unaffected, provided that processing remains possible and reasonable.

§ 7 Liability

(1) The organizer is liable without limitation for damages resulting from injury to life, body, or health, as well as for damages caused by intent or gross negligence.

(2) For damages resulting from the breach of an essential contractual obligation due to simple negligence, the organizer is liable only for the foreseeable damage typical for this type of contract. Otherwise, liability for simple negligence is excluded.

(3) The organizer is not liable for impairments to the competition caused by disruptions or failures of technical facilities and communication channels (e.g. the respective social media platform) beyond its control.

§ 8 Data Protection

(1) The controller for the processing of personal data is Ecomsky GmbH, Rote Straße 19, 37073 Göttingen, email: Support@eilusade.com.

(2) The organizer processes the data collected in connection with participation (in particular account name, in the event of winning, name, contact details, and address) exclusively for the implementation and processing of the respective competition. The legal basis is Art. 6(1)(b) GDPR.

(3) The data will be deleted — subject to statutory retention obligations — as soon as it is no longer required for the implementation of the competition. For the delivery of prizes, the necessary data may be passed on to shipping service providers.

§ 9 Final Provisions

(1) Legal recourse with regard to the determination of the winners is excluded. Statutory claims of the participants remain unaffected.

(2) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the state in which participants have their habitual residence remain unaffected.

(3) Should individual provisions of these terms and conditions of participation be or become invalid, the validity of the remaining provisions shall remain unaffected.
